The petitioner is seeking anticipatory bail in connection with Marhaura P.S. Case No. 496/2018 registered under Sections 25(1-b)a/26/35 of the Arms Act and 399/402 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per prosecution version that when the informant along with police party proceeded to arrest the wanted accused Rabindra Kumar Raut and reached in the village he got secret information that the warranted accused along with his associates are making planning to commit crime and are present in mango orchard at Bardahiya Dih Village, police raided there and arrested the warranted accused. It is stated that petitioner's name has

Patna High Court CR. MISC. No.18286 of 2019(2) dt.04-04-2019 2/2 transpired in the confessional statement of co-accused and no other material to connect the petitioner in the present case. However, petitioner has no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case wherein it is the submission of the petitioner that his name has transpired in the confessional statement of the co-accused but apart from that there is no other material to connect him in the present case and further that he has no criminal antecedent, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 8th, Saran at Chapra, in connection with Marhaura P.S. Case No. 496/2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
