Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Narhat P.S. Case No. 244 of 2020 lodged under Sections 341, 342, 364, 406, 420, 504, 506, 34 of the Indian Penal Code read with Section 27 of the Arms Act.

As per the allegation the petitioner is involved in committing offence of abduction for ransom, he is also involved in ATM fraud matters.

Learned counsel for the petitioner submits that the present case has been filed against 6 named accused persons. He further submits that Co-accused Gautam Kumar @ Gautam

Patna High Court CR. MISC. No.19417 of 2022(3) dt.08-08-2022 2/3 Singh having 9 criminal antecedents have been granted bail by the Co-ordinate Bench of this Court vide order dated 16.05.2022 passed in Cr. Misc. No.34037 of 2021. He further submits that nothing incriminating recovered from the possession of the petitioner nor TIP takes place. On the point of his criminal antecedent, learned counsel for the petitioner submits that petitioner is ready to fulfill all the conditions imposed by the Court.

Learned counsel for the State opposes the prayer for bail and submits that petitioner's name may not be clear in commission of the crime but certainly he is a member of a gang who used to commit ATM fraud and demand ransom. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Nawada in connection with Narhat P.S. Case No. 244 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions:

A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date

Patna High Court CR. MISC. No.19417 of 2022(3) dt.08-08-2022 3/3 fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall resulted into cancellation of his bail bond.

B. One of the bailor shall be close relative who shall file affidavit before the court about his relation with the petitioner.

C. The petitioner shall file an affidavit at the time of furnishing of bail bond that he shall not involve in such criminal activity during the continuance of present bail bond, violation of this condition shall be resulted into cancellation of his present bail bond.

With this observation, the bail application stands allowed.
