The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 397 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that two unknown accused persons with their faces covered, on the point of pistol robbed the informant of his motorcycle as also his mobile phone.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation when the looted mobile phone was recovered from the possession of the petitioner. It is the case of the petitioner that he has been falsely

Patna High Court CR. MISC. No.19762 of 2022(3) dt.09-01-2023 2/2 implicated in the case. He had purchased the said mobile phone and had been assured that he would be provided with the papers. The petitioner is in custody since 18.1.2022, chargesheet has been submitted in the case and he has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for more than 11 months since 18.1.2022, chargesheet having been submitted in the case and his not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Begusarai Mufassil P.S. Case no.513 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai.
