JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 457 and 380 of the Indian Penal Code. Prosecution case, according to the informant, is that unknown persons have committed theft in his house and taken away valuable articles including cash of Rs.45,000/-. It has been submitted on behalf of the petitioner that petitioner is in custody since 22.4.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P.

There is no recovery of any incriminating article from the possession of the petitioner. Name of the petitioner has come in the confessional statement of the co-accused. Similarly situated other co-accused has already been granted bail vide Cr. Misc. no. 16240 of 2016. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.33414 of 2016 (3) dt.23-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-12th cum Addl. Chief Judicial Magistrate, Muzaffarpur, in connection with Bela P.S. Case no. 24 of 2015.
