The petitioner seeks bail in Khajekalan P.S. Case No. 137/2017, instituted for the offences under Sections 147, 148, 149, 302 and 201 of the Indian Penal Code.

It is alleged in the written report that this petitioner and other named accused along with 50-60 unknown accused persons brutally assaulted Prakash Yadav, on account of which he died. Thereafter, they threw the dead body of Prakash Yadav in the river.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. There is no allegation of any specific overt act against him. He has been named in this case only

Patna High Court Cr.Misc. No.55289 of 2018 (2) dt.20-09-2018 2/2 on suspicion. He is in custody since 10.06.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Patna City, Patna in connection with Khajekalan P.S. Case No. 137/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
