Mr.Anil Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 10-05-2024 Heard Mr.Pankaj Kumar, learned counsel appearing for the petitioner and Mr.Anil Kumar, learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail, who is in custody since 19.04.2023 in connection with S.Tr.No.486 of 2023 arising out of Amarpur P.S. Case No.532 of 2021, F.I.R. dated 07.11.2021 registered for the offence punishable under Sections 307,304B of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 25.09.2023 passed in Cr.Misc. No.55300 of 2023.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been

No.22748 of 2024(3) dt.10-05-2024 2/2 implicated in the present case on the ground that the petitioner is husband of the deceased and in fact no such occurrence had taken place and the victim has received burn injury due to an accident and the petitioner also received one injury.

5. Vide order dated 20.03.2024 a report was called for with regard to the present status of the trial. Report of the learned Trial Court dated 23.03.2024 reveals that the trial has began and witnesses have been examined.

6. Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner.

7. Considering aforesaid facts, trial has began and there is direct and specific allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.486 of 2023 arising out of Amarpur P.S. Case No.532 of 2021, pending in the court of learned Additional Sessions JudgeII, Banka.

8. Prayer is refused.

9. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
