Petitioner is accused in connection with Dulhin Bazar P.S. Case No. 181 of 2015 registered under Sections 302, 201, 34 of the I.P.C.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, name of the petitioner has surfaced in the supervision note of D.S.P., as detailed in paragraph no. 46 of the case diary, which reveals that one Chhotu Kumar detailed before the Police that this petitioner was seen near the dead body and on asking, he did not try to keep out the deceased from the water. Thereafter, the petitioner was apprehended by the Police, who recorded the
Patna High Court Cr.Misc. No.26160 of 2016 (3) dt.10-08-2016 2/2 confessional statement of the petitioner showing his involvement in the present case. Except that, there is nothing against the petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 07.01.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Danapur in connection with Sessions Trial No. 389 of 2016/657 of 2016 arising out of Dulhin Bazar P.S. Case No. 181 of 2015.
