The petitioners seek bail in a case instituted for the offences under Sections 341, 323, 363, 366A, 368, 370(A), 370(D), 372, 373, 120B/34 of the I.P.C. as well as Sections 3, 4, 5, 6 of the Immoral Traffic Act and Sections 4/8 of the POCSO Act.

The allegation against the accused persons including the petitioners is that they compelled the informant for prostitution and also tortured her.

It has been submitted on behalf of the petitioners that the petitioners No. 1 and 2 are in custody since 6.5.2016 and 19.4.2016 respectively and the charge sheet has been submitted in

Patna High Court Cr.Misc. No.34114 of 2016 (3) dt.29-09-2016 2/2 the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case as the petitioner No.2 had refused to marry the victim. The other co-accused has been granted bail vide Cr.Misc.No.36064 of 2016.

On behalf of the State and the learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Begusarai in connection with Baliya P.S. case No.62 of 2016 (POCSO case No.10 of 2016).
