JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 47(a)(e)/53 of the Bihar Excise Amendment Act, 2016. Six litres country made Mahua wine and 25 kg. Mahua flower are said to have been recovered from the house of the petitioner for which petitioner is in jail custody since 4.5.2016. Contention on behalf of the petitioner is that petitioner does not have any criminal antecedent and even if the aforesaid recovery is assumed to be true, then also, the said recovery has been made from the joint house.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of
Patna High Court Cr.Misc. No.29916 of 2016 (2) dt.28-07-2016 2/2 detention of the petitioner in jail custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Dehri in connection with Rohtas P.S. Case No.85 of 2016.
