JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with G.R.P. Patna Junction Rail P.S. case no. 124 of 2018 for the offence under Sections 137/147 of the Railway Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the petitioner was arrested on the allegation that he was involved in pick-pocketing from Platform no.3 of Patna Junction. Learned counsel submits that the article, which was recovered from the possession of the petitioner, does not indicate that any pick-pocket was committed by the petitioner. The petitioner is in custody since 24.04.2018.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody since 24.04.2018, the

Patna High Court Cr.Misc. No.54749 of 2018 (2) dt.28-09-2018 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each after 21.10.2018 to the satisfaction of Additional Chief Judicial Magistrate, Railway, Patna in connection with G.R.P. Patna Junction Rail P.S. case no. 124 of 2018.
