Sri Ram Naresh Roy, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Surya Narayan Roy, learned counsel for the petitioner and Sri Ram Naresh Roy, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 24.09.2017 in connection with Dalsinghsarai P.S. Case No. 303 of 2017 registered for offence under section 30(a) , 38 and 41 of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail purely on parity.

Learned counsel for the petitioner submits that in similar circumstances one of the co- accused namely, Amar Nath Sah who was arrested on the same day, has been granted bail by order dated 20.11.2017 passed in Cr. Misc. No. 55491 of 2017. He submits that only on suspicion petitioner was arrested. Considering the fact that co- accused in similar

Patna High Court Cr.Misc. No.56384 of 2017(2) dt.04-12-2017 2/2 circumstances has been granted the privilege of bail, there is no reason to deny the same privilege to the petitioner. Besides this , petitioner is having clean antecedent , which fact has been stated in paragraph no. 3 of the petition.

In view of the facts and circumstances, let the petitioner Sant Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Samastipur / concerned court in connection with Dalsinghsarai P.S. Case No. 303 of 2017.
