16-08-2016 Heard Sri Ranjeet Kumar Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 20-05-2016 in Sidhwalia P.S. Case No. 38 of 2016 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 324, 325, 379, 504 of the Indian Penal Code and Section 3(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that there was case and counter case in between the parties. He submits that from the petitioner's side, on the same date, an F.I.R. was lodged, vide Sidhwalia P.S. Case No. 39 of 2016 for offence under Sections 147, 148, 149, 323, 307, 324, 325 & 504 of the

Patna High Court Cr.Misc. No.32060 of 2016 (2) dt.16-08-2016 2/2 Indian Penal Code against the informant side of the present case. By way of referring to Annexure - 3 series to the present petition, he submits that from the petitioner's side, number of persons have received serious injuries.

In view of the fact that there was case & counter case in between the parties as well as the period of custody and nature of accusation, let the petitioner namely Parma Thakur be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - VIII, Gopalganj in connection with Sidhwalia P.S. Case No. 38 of 2016.
