JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-02-2018 The petitioner is apprehending his arrest in connection with Kodhobari P.S. Case No. 20 of 2017, registered for offences punishable under Sections 409 and 420 of the IPC. Petitioner is headmaster of the concerned school and allegation against him is of misappropriation of Government Money meant for construction of the school building. It has been submitted on behalf of the petitioner that construction of the scholl building, has already been done till roof level and he undertakes to complete the remaining work within a period of six months, if allowed the privilege of pre-arrest bail. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with
Patna High Court Cr.Misc. No.4142 of 2018 (2) dt.02-02-2018 2/2 direction to the court below to enlarge the petitioner on provisional bail for a period of six months on the undertaking of the petitioner that he shall complete the remaining work within a period of six months and once the work is completed and the court below after verifying the certificate issued by the District Program Officer, shall confirm the provisional bail of the petitioner otherwise he is free to pass any order as he deems fit and proper.
