The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/448/354/380/504/506 of the Indian Penal Code.
The prosecution case is that the accused persons entered into the courtyard of the informant and started abusing. It is alleged against petitioner no.4 that he abused and threatened the informant on the point of pistol whereas petitioner no.2 dragged the daughter-in-law of the informant from the house. It is further alleged that all the accused person robbed clothes and ornaments of the informant, worth
Patna High Court Cr.Misc. No.34665 of 2015 (2) dt.17-08-2015 2/2 Rs.25,000/-. The accused persons also took away other articles worth Rs.15,000/- from the house of the informant. It is submitted by learned counsel for the petitioners that the petitioners' side lodged Singheswar P.S. Case No.93 of 2014 at earlier point of time against the present informant and others, hence, in order to save her skin, the present case has been lodged. From the narration of the complaint, it appears that none has received any injury. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No.80 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
