JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act. One loaded country made katta and one live cartridge are said to have been recovered from conscious possession of the petitioner when petitioner and others, allegedly, assembled to make preparation for committing dacoity. Moreover, petitioner is in jail custody since 30.12.2015 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as
