JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State as also the learned Counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in Andar PS Case No. 191 of 2017 registered under Sections 341, 323, 307, 504 and 506/34 of the IPC.

The allegation in brief is that step brother of the informant assaulted him and the specific allegation is that this petitioner gave a dab blow over his head causing injury to him. Submission is that there is property dispute, the informant and the petitioner are step brothers, allegation is of a single blow of dab, a sharp cutting weapon, but there is no cut injury over head of the informant rather there is one lacerated would. Charge-sheet has been submitted in this case, the petitioner is in custody since 6.11.2017 and there is only one case lodged against him that too between the same parties.

Having considered the said facts and circumstances, the petitioner Sri Niwas Prasad @ Chhotey @ Sri Niwas is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Siwan in connection with Andar PS Case No. 191 of 2017.
