JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise Case No. 113 of 2018 (P. R. No. 26 of 2018) for the offence under Section 30(a) and 56 (d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is in custody since 22.07.2018 in connection with seizure of 40 litres of liquor. He further submits that similarly circumstanced co-accused Sudesh Kumar has been granted bail vide order dated 10.09.2018 passed in Cr. Misc. No. 56055 of 2018.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds

Patna High Court Cr.Misc. No.54715 of 2018 (2) dt.28-09-2018 2/2 of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Gaya in connection with Excise Case No. 113 of 2018 (P.R. No. 26 of 2018).
