The petitioners seek bail in anticipation of their arrest in connection with Bihar P.S. Case No. 437 of 2018 dated 27.09.2018 instituted for the offences under Sections 341, 323, 325, 307, 504, 34 and 379 of the Indian Penal Code.

The petitioners along with two others are said to have assaulted the informant while he was coming back home. The informant has received as many as five injuries, out of which one appears to have been caused by a sharp cutting weapon. All the injuries have been opined to be simple in nature.

Learned counsel for the petitioners has

Patna High Court CR. MISC. No.17792 of 2019(2) dt.28-03-2019 2/2 submitted that there is a counter version of the occurrence also which has been lodged by other coaccused persons of this case. It appears that there is a general dispute between the parties and taking advantage of some simple injuries on the person of the informant, the present case has been filed.

Considering the background facts and taking into account the nature of accusation and clean antecedents of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Bihar P.S. Case No. 437 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
