JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2019 The above mentioned Criminal Miscellaneous application was filed on behalf of Uday Patel with a prayer for bail in connection with Special Case No. 43 of 2018 pending in the Court of the learned Special Judge, NDPS, Patna registered under Sections 23, 27 and 29 of the NDPS Act. Considering the recovery between the small and commercial quantity, the investigation being concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent and the fact that petitioner is languishing in custody since 5.5.2018, the petitioner was granted bail vide order dated 2.4.2019. On 17.4.2019, the matter was mentioned by Mr. S.D. Sanjay, the learned Additional Solicitor General with a payer for hearing the matter on behalf of Directorate of Revenue Intelligence. Hence, the matter was adjourned to 24.4.2019 but on that day, none appeared on behalf of Directorate of Revenue Intelligence. Thereafter, the matter was adjourned to 15th May, 2019 but on that day also none appeared on behalf of Directorate of Revenue Intelligence, hence the matter was adjourned for today.

Today also, none appears. Hence, the office is expected not to list this matter till any petition is filed for modification of order dated 2.4.2019.
