Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47 of Bihar Excise (Amendment) Act, 2016. 480 plastic bottles each containing 200 ml. country made liquor are said to have been recovered from the house of the petitioner but according to prosecution case itself, petitioner was not caught on the spot rather he managed to escape from there. The wife of the petitioner was arrested on the spot. Submission on behalf of the petitioner is that nothing was recovered from the house of the petitioner and as a matter of

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 96 of 2016.
