This is an application for regular bail in connection with Laxmipur P. S. Case no. 209 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.

Allegation against petitioner is that he along with other coaccused persons assaulted informant with axe due to some petty dispute with regard to irrigation. His father and mother were also assaulted by the accused persons when they came to rescue him.

It is submitted on behalf of petitioner that he has got no criminal antecedent. He is innocent and has falsely been implicated in the present case. No case under Section 307 of the Indian Penal Code is made out against him. There is case and

Patna High Court Cr.Misc. No.430 of 2018(2) dt.17-01-2018 2/2 counter case between the parties and both sides have received injuries. No witnesses have supported the prosecution case. He is in judicial custody since 30.10.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-3rd, Jamui, in connection with Laxmipur P.S.
