JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-01-2021 This writ application has been preferred by the petitioner for direction to the respondents to issue fresh marksheet of Intermediate Annual Examination 2018 in science faculty with marks of Mathematics Paper.
Today a counter affidavit has been filed on behalf of the Bihar School Examination Board, Patna and its authorities (respondent nos. 1 to 4).
Mr. Girijesh Kumar, learned counsel for the Board has drawn the attention of this Court towards paragraph '4' of the counter affidavit. In paragraph '4' of the counter affidavit, it is stated that the grievance of the petitioner has been redressed and the issues have been resolved. It is also stated that the correct
Patna High Court CWJC No.7891 of 2019(3) dt.13-01-2021 2/2 marksheet/provisional certificate has been issued to the petitioner who has secured 258 marks and has been placed in second division.
The same stand has been further taken in paragraph '8' and '9' of the counter affidavit.
In the nature of the dispute and the stand disclosed in the counter affidavit, this writ application has become infructuous and is being disposed of accordingly.
