JUSTICE RAKESH KUMAR ORAL ORDER 10-09-2018 At the very outset, learned counsel for the petitioner requests for allowing him to make correction in paragraph-1 of the petition to the extent of correcting the name of the Excise Act.

The prayer is allowed.

He is permitted to make correction in course of the day.

Heard Sri Shailesh Kumar, learned counsel for the petitioner. None appeared on behalf of the State. The sole petitioner, apprehending his arrest in Konch P.S. Case No. 230 of 2018 registered for offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

No.53735 of 2018(2) dt.10-09-2018 2/3 At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner has been made an accused on an accusation, as if, from the Freez of the shop of the petitioner , two bottles; one containing 750 ml. of Indian Make Foreign liquor and another containing 375 ml. of Indian Make Foreign Liquor were recovered. He submits that without any recovery of Indian Make Foreign liquor, a false case has been made.

Considering the nature of accusation as well as clean antecedent of the petitioner, let the petitioner, namely, Shashi Shekhar Singh @ Munna Singh @ Shashi Kumar @ Shashi Kumar Singh , in the event of his arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Konch P.S. Case No.230 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
