Petitioner is accused in connection with Motihari Town P.S. Case No. 193 of 2016 registered under Sections 394 of the I.P.C., 27 of the Arms Act and 3⁄4 Explosive Substance Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, one Brij Bihari Sharma apprehended by the Police in connection with Motihari Town P.S. Case No. 198 of 2016, who confessed his guilt showing the involvement of the petitioner hurling the bomb at the time of occurrence. Except the confessional statement of co-accused, there is no material against the petitioner. It is also submitted that except this case, petitioner
Patna High Court Cr.Misc. No.26311 of 2016 (3) dt.10-08-2016 2/2 is accused in two other cases, but in both cases, he is on bail and in the present case, petitioner is in custody since 22.04.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran at Motihari in connection with Motihari Town P.S. Case No.193 of 2016.
