The petitioner seeks bail in connection with Saraiya (Jaitpur O.P.) 957 of 2022 registered for the offence under 30(a) of the Bihar Prohibition and Excise Act and Section 272/273/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 31.12.2022 and there is recovery of 125.00 liters of illicit mixed toddy.

Learned Additional Public Prosecutor has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery of

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Court No. II, Muzaffarpur in connection with Saraiya (Jaitpur O.P.) 957 of 2022.
