JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends arrest in connection with Ara Mufassil P.S. Case No. 89 of 2014 registered for the offences punishable under Sections 420, 409, 467 & 468 read with 34 of the Indian Penal Code.

It has been contended that the petitioner has been made victim of the enmity of Mukhiya and the informant whose wife is ward member. The main role in distribution of B.P.L. coupon is of Mukhiya and local public representative and the implication of the petitioner has got no stands. The petitioner is a Panchayat Secretary and being Panchayat Secretary, he is simply a representative of the government in distribution of coupon. It has further been contended that the petitioner is a government employee and would attain the age of

Patna High Court Cr.Misc. No.42204 of 2014 (2) dt.20-03-2015 2 / 2 superannuation in 2016 and apart from the present case, he is not involved in any other case.

Learned counsel for the State has opposed the prayer for anticipatory bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, let the petitioner be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Mufassil P.S. Case No. 89 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
