The petitioner is apprehending his arrest in Amdabad P.S. Case No. 183 of 2019 registered under Sections 341, 323, 324, 307, 354, 506 and 34 of the Indian Penal Code. The prosecution allegation, in short, is that on account of land dispute, the accused persons assaulted the informant and other family members due to which they sustained injuries. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. For petty reason, the alleged occurrence is said to have taken place. At best, it is a case for an offence under

Patna High Court CR. MISC. No.16274 of 2020(2) dt.23-03-2021 2/2 section 325 IPC.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. Specific allegation against the petitioner is that he assaulted with hasua on the head of the brother of the informant. As per injury report, the said injury on the head is grievous in nature.

Considering the same, I am not inclined to grant anticipatory bail to the petitioner. The prayer is rejected. (Sudhir Singh, J) Pankaj/- U T
