The petitioner seeks bail in Agam Kuan P.S. Case No. 109/2018, instituted for the offences under Sections 414 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is no recovery from possession of this petitioner. Name of this petitioner has transpired in the statement of co-accused Rohit Kumar, from whose possession motorcycle is alleged to have been recovered. It is further submitted that aforesaid Rohit Kumar has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 37685/2018 dated 10.07.2018.
The petitioner is in custody since 18.06.2018.
Patna High Court Cr.Misc. No.51397 of 2018 (2) dt.26-09-2018 2/2 Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, Patna in connection with Agam Kuan P.S. Case No. 109/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
