This is a case registered under Section 395 of the Indian Penal Code.

It is submitted by counsel for the petitioner that he has falsely been implicated in this case on allegation that he has been identified in some CCTV footage. He submits that after his arrest on 19.04.2018, till date he has not been put on Test Identification Parade. Charge sheet has already been submitted in this case as such there is no chance of tampering with the evidence. Considering the aforesaid submissions of the petitioner's counsel, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the

Patna High Court Cr.Misc. No.54892 of 2018 (2) dt.07-09-2018 2/2 like amount each to the satisfaction of learned Judicial Magistrate, Birpur (Supaul) in connection with Nirmali P.S. Case No. 52 of 2018 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
