JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Maharajganj P. S. Case No. 150 of 2016 registered under Sections 302, 201 and 120-B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the first information report has been instituted by the Dafadar Lal Babu Singh implicating the petitioner and four others merely on hypothetical presumption and wild suspicion. He submitted that there is no eye witness of the occurrence and the body of the victim has not been recovered. He contended that the petitioner is the married sister of Rustam Khan and lives

Patna High Court Cr.Misc. No.58361 of 2017 (2) dt.12-12-2017 2/2 separately and she has no concern with the alleged murder of the daughter of Rustam Khan.

On the other hand, learned Additional Public Prosecutor submitted that Dafadar has suspected that the daughter of Rustam Khan might have been killed by Rustam Khan and his family members, as she was having affair with one Md. Rizwan of village Bhikha Bandh which was not liked by the family members.

Considering the submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in Maharajganj P. S. Case No. 150 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
