JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 The present application has been filed for modification of the order dated 05.09.2012 passed in Cr. Misc. No. 32323 of 2012 for extending the period of surrender. The petitioners being parents of the husband of the informant were granted anticipatory bail in a case registered for the offences punishable under Sections 120B, 323, 504, 498A, 384, 386 of the Indian Penal Code. It is submitted by learned counsel for the petitioners that due to ill health and misinformation the petitioners could not surrender within the stipulated period of time.

The order dated 05.09.2012 reflects that period of twelve weeks were granted for execution of the bail bonds when the present modification application has been filed

Patna High Court Cr.Misc. No.34948 of 2015 (2) dt.26-08-2015 2/2 on 28.07.2015.

In the circumstance, this Court is not inclined to entertain the present modification application. Let learned Court below consider the prayer for regular bail of the petitioners, keeping in view of the facts that on merits the petitioners were granted anticipatory bail, if the petitioners surrender within a period of six weeks and pray for regular bail in connection with Parsauni P.S. Case No. 92 of 2011, pending in the Court of learned Chief Judicial Magistrate, Sitamarhi.

Accordingly the modification application is disposed of.
