Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

It is alleged against the petitioner that the petitioner misappropriated Rs. 5,000/- allocated for excursion scheme for the year 2005-06 to 2009-10.

It is submitted by the learned counsel for the petitioner that petitioner has already deposited Rs. 5,000/- and he has now retired.

Considering the fact that the case was registered in 2010, Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before

Patna High Court Cr.Misc. No.34547 of 2015 (2) dt.25-08-2015 the learned court below within a period of six weeks from today in connection with Aurai P.S. Case No. 139 of 2010, pending in the court of learned Sri Jawed Alam, Judicial Magistrate, Ist Class, Muzaffarpur.

With the above observation this application is disposed of.

It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day, keeping in view of meager amount involved which is claimed to have been deposited and the fact that petitioner has already retired.
