The petitioner being the husband of the informant is languishing in custody since 25.04.2016 in a case registered for the offences punishable under sections 341, 323, 504, 498A and 34 of the Indian Penal Code.

Basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant. The petitioner was granted provisional anticipatory bail, for a period of four months; by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.14219/2015, on readiness to keep the informant as wife with dignity and honour. The provisional bail of the petitioner was to be confirmed by the learned Court below

Patna High Court Cr.Misc. No.30283 of 2016 (2) dt.25-07-2016 2/2 in two eventualities; if the issue being reconciled between the parties or, if the informant gets reluctant to reconcile the issue. But in view of non-resolution of the issue between the parties, the petitioner was taken into custody.

Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jamui, in connection with Simutalla P.S. Case No.62/2014.
