JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 467, 468, 471, 420, 406/34 of the Indian Penal Code.

Petitioner is not named in the first information report but it is submitted on behalf of the petitioner that concerned B.D.O. enquired into the allegation levelled by the informant and in course of enquiry, the concerned B.D.O. doubted about the involvement of the petitioner in the present crime. It is further submitted that except the above stated suspicion raised by the concerned B.D.O. in course of enquiry, there is nothing against the petitioner. However, petitioner has already deposited Rs. 30,000/-

Patna High Court Cr.Misc. No.30645 of 2016 (2) dt.08-08-2016 2/2 without admitting the prosecution case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 71 of 2014.
