The petitioners, who are in custody, seek bail in
Patna High Court Cr.Misc. No.2643 of 2018(3) dt.12-02-2018 2/3 connection with Special Case No. 100 of 2017 arising out of Sultanjganj P.S. Case No. 157 of 2017 registered for the offence punishable under Sections 401, 413, 414/34 of the Indian Penal Code and Section 20/22 of NDPS Act.
Allegation against the petitioners is on specific information received by the police, house of the petitioners was raided and there was recovery of 13.19 gram of smack and 33 gram of Ganja and same were kept in 13 and 25 puriya and recovered from the (wife) of the petitioner and (mother) of petitioner and from the box in the room. There has also been recovery of stolen mobiles.
Learned counsel for the petitioners submitted that they are innocent and have been falsely implicated in this case. It has further been submitted that Petitioners were not arrested from the spot and they are in custody since 22.09.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-IIIrd, Cum-Special Judge,
