Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.
It is alleged that petitioner in connivance with other co-accused got lease deed with regard to the land of the informant fraudulently and subsequently on the said land and other land he started digging for construction of pond. It is submitted by learned counsel for the petitioner that lease deed has still not been cancelled and lease deed dated was registered on 28.04.2014 when the present case was registered on 04.08.2014. The petitioner is agnate of the informant and on the basis of lease deed the land possession certificate was issued.

No.32570 of 2015 (2) dt.10-08-2015 2/2 Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, Motihari in connection with Keseriya P.S. Case No. 153 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
