The petitioner seeks bail in connection with Kanti P.S. Case No. 552 of 2019 registered for the offence under Section 397 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.14823 of 2020 and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody since 16.12.2019. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.17263 of 2020(4) dt.02-09-2020 2/2 case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur in connection with Kanti P.S. Case No. 552 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case as well as the petitioner shall not leave the country without permission of the learned Trial Court, failing which, the court below shall be at liberty to cancel the bail bond of the petitioner.
