The petitioner is accused in connection with Majorganj P.S. Case No. 76 of 2016, registered under Section 272, 273 of the Indian Penal Code and Section 47 (a) of the Excise Act.
The accusation is that one Shankar Sahni was apprehended by the Police having 186 plastic bottle of Nepali safi each containing 300 ML in a white colour bag, who disclosed that he is going to sell the same to this petitioner at Motihari.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not

No.28037 of 2016 (2) dt.15-07-2016 2/2 apprehended by the Police with liquor, rather co-accused Shankar Sahani was apprehended with said liquor and he disclosed the name of the petitioner saying that he is going to sell it to the petitioner, except the confessional statement, there is nothing against the petitioner. The petitioner having no criminal antecedent is in custody since 10.04.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-Ist, Sitamarhi in connection with Majorganj P.S. Case No. 76 of 2016.
