JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 23-07-2019 Learned counsel for the petitioner submits that now in view of the judgments of this Court he would file an application for provisional release of the vehicle in question before the District Magistrate, Nalanda within a period of three weeks from today. Learned counsel submits that this Court may direct the District Magistrate, Nalanda to give some priority to the application for provisional release because in this case the vehicle in question is an Auto of the petitioner from which he earns his livelihood.

In the given facts and circumstances of the case,

Patna High Court CWJC No.6870 of 2019(2) dt.23-07-2019 2/2 learned counsel for the State has no objection to passing of such order.

Having heard learned counsel for the parties, this Court is disposing off this writ application with liberty to the petitioner to file an appropriate application for provisional release of the vehicle in question before the District Magistrate, Nalanda (Respondent No. 3) within three weeks from today and in case such an application is filed within the aforesaid period, the Respondent No. 3 shall consider and dispose off the same within three weeks thereafter keeping in mind the judicial orders of this Court in such matters of provisional release. The writ application stands disposed off.
