2. The petitioner apprehends his arrest in a case registered for an offence punishable under sections 395 and 412 of the Indian Penal Code.

3. As per allegation in the FIR, while the informant was travelling in the train from Kahalgaon to Samastipur and when the train reached at Mankatha station on 07.02.2023, 7-8 miscreants entered in the train and started looting personal belongings of the passengers such as cash, mobiles etc. at the point of pistol.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and he is not

Patna High Court CR. MISC. No.23860 of 2024(3) dt.15-07-2024 2/2 named in the FIR and his name has been made on the basis of the confessional statement of co-accused Tinku Kumar. Similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 3041 of 2024.

5. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the court within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Rail (Kiul) P.S. Case No. 15 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
