JUSTICE JITENDRA KUMAR ORAL ORDER 29-08-2025 The present Criminal Writ Petition has been preferred against the impugned order dated 06.02.2021, passed by learned Special Judge, NIA, Patna in Special Case No. 7 of 2019, RC31/2018, C.I.S. 07/19 titled Manjar Alam & Others Vs. State through N.I.A., whereby learned Special Judge has rejected his application for release of cash of Rs.29,06,410/- along with the other articles seized.

2. However, learned counsel for the Petitioner submits

Patna High Court CR. WJC No.780 of 2021(13) dt.29-08-2025 2/2 that this Writ Petition was inadvertently filed because as per the N.I.A. Act, every order of the N.I.A, Court is appealable, and hence, the Petitioner is required to file appropriate appeal against the impugned order.

3. Hence, he is seeking permission to withdraw the present petition so that he can file appropriate appeal against the impugned orders in the matter.

4. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty as sought for by the Petitioner.
