The petitioners seek bail in connection with Barhara P. S. Case No. 296 of 2021 registered for the offence punishable under Sections 304B and 201/34 of the Indian Penal Code. As per the prosecution case, the allegation against the petitioners is that they have committed murder of the daughter of the deceased due to non-fulfillment of the dowry demand and disappeared her dead body.
Learned counsel for the petitioners submits that petitioners are Devar, Mother-in-law and Gotni of the deceased
Patna High Court CR. MISC. No.19458 of 2023(2) dt.18-05-2023 2/2 respectively who were living separately since long from the deceased and her husband and they had nothing to do with their family affairs. There is no specific allegation against the petitioners. It is further stated that FIR has been lodged after seven days which is afterthought. Petitioner Nos. 2 and 3 are women. Petitioners are in jail custody since 25.11.2022. They have no criminal antecedent.
Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - II, Purnea in connection with Barhara P. S. Case No. 296 of 2021.
