ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner, being the Driver of the truck in question which was seized by the police, is apprehending his arrest in connection with Rajauli P.S. Case No.98 of 2015 for allegedly having committed the offences under Sections 420, 467, 468, 471, 414, 379 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the truck so seized have all valid papers and was moving with the valid Suvidha documents. Learned counsel further submits that at best it can be treated as a case of overloading. So far as the petitioner is concerned, he is merely a Driver and has nothing to do with such actions.

No.32305 of 2015 (2) dt.17-08-2015 2/2 Considering the aforementioned facts and circumstances and the nature of allegations, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S.
