JUSTICE SANJAY PRIYA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Jakkanpur P.S. Case No. 323/2018, instituted for the offences under Sections 401, 420 and 379 of the Indian Penal Code.

It is alleged in the written report that this petitioner introduced the informant to another person as his Sir and asked the informant to hand over his bag to aforesaid person, which was containing Rs. 40,000/- and articles worth Rs. 10,000/-. The said person went away with the said bag and did not return. Learned counsel for the petitioner has submitted that it is mentioned in the written report that petitioner was apprehended on the spot. There is no recovery of any incriminating article from

Patna High Court Cr.Misc. No.54051 of 2018 (2) dt.04-10-2018 2/2 his possession. He has clean antecedent. He is in custody since 16.07.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S. Case No. 323/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
