JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code and Section 17 of C.L.A. Act.

Petitioner is not named in the first information report but in course of investigation, the name of one Krishna Kumar Pandariya came to light and it was also detected that mobile no. 9798520731 through which the demand of extortion money was given, stood in the name of aforesaid Krishna Kumar Pandariya. Subsequently, the name of one Kundan Kumar was also came to light and the aforesaid Kundan Kumar confessed his guilt disclosing the name of the petitioner. It appears that except the

Patna High Court Cr.Misc. No.30647 of 2016 (2) dt.08-08-2016 2/2 aforesaid confessional statement as well as some criminal antecedent of the petitioner, there is nothing against the petitioner, who is languishing in jail custody since 02.04.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Imamganj P.S. Case No. 148 of 2015.
