JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Alamganj P.S. Case No. 145 of 2018 instituted for the offence under Section 120(B) of the Indian Penal of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of Arms Act.

Counsel for the petitioner submits that petitioner has not been apprehended on the spot. One Gautam Kumar @ Kallu was apprehended by the police with firearm as mentioned in the written report. He disclosed before the police that this petitioner has supplied him the firearm. There is no recovery of any incriminating article from possession of petitioner. Petitioner is said to be in custody since 28.03.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
