JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and it appears that there is allegation of dowry death against the petitioner.
Submission on behalf of the petitioner is that the deceased died of her ailment and her dead body was cremated in presence of informant but, subsequently, informant with an ulterior motive lodged this case against the petitioner and his other family members. It is informed that parents of the petitioner have already been granted privilege of anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the
Patna High Court Cr.Misc. No.31594 of 2016 (3) dt.17-10-2016 2/2 petitioner on bail and hence, his prayer for bail in connection with Tandwa P.S.Case No. 49 of 2015, pending in the court of Judicial Magistrate, 1st class, Aurangabad stands rejected, at least, at this stage.
However, petitioner may renew his prayer for bail after six months, if his trial is not concluded within the above stated period.
