12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Kartahan P.S. Case No. 26/2017 registered for the offence punishable under Sections 393, 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R., his name has transpired in the confessional statement of the coaccused. He has been remanded in this case on 22.06.2017 but till date no T.I. Parade has been conducted to identify him in connection with this case.

Learned counsel submits that there are some

No.301 of 2018 (2) dt.12-01-2018 cases against this petitioner which are stated in paragraph 3 but in all such cases he has been implicated on the basis of confessional statement of co-accused. He submits that the petitioner is ready to co-operate with the trial. On the other hand, learned counsel for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the present case though there are some cases in which this petitioner is said to be an accused, however in the present case, he has been on remand since more than six months and no T.I. Parade has been conducted for the purpose of identification, a charge-sheet has already been submitted against him in connection with this case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - Vth Vaishali at Hazipur, in connection with Kartahan P.S. Case No.

Patna High Court Cr.Misc. No.301 of 2018 (2) dt.12-01-2018 trial by putting his appearance on each and every date fixed in the court below. Two consecutive defaults, without any plausible reason in putting appearance before the trial court, would lead to cancellation of bail bond of the petitioner. This application is disposed off.
