JUSTICE DINESH KUMAR SINGH) 19-07-2019 It appears from the record that the present Miscellaneous Appeal No. 130 of 2019 has been preferred for setting aside the order dated 26.10.2010, passed by the learned Principal Judge, Family Court, Khagaria in Guardian and Ward Case No. 4 of 2018, whereby the appellant's claim for the custody of the minor child under section 25 of the Guardian and Ward Act, has been dismissed.
The present appeal has been filed by two advocates, namely, Ranjit Kumar Singh, A.O.R. No. 00328 and Pawan Kumar Singh, A.O.R. No. 01897.
It appears that against the same impugned
Patna High Court MA No.130 of 2019(3) dt.19-07-2019 2/2 judgment, earlier Miscellaneous Appeal No. 947 of 2010, which has wrongly been listed in the cause list as M.A. No. 974 of 2010, was filed and was dismissed by a Bench of this Court vide order dated 19.06.2014.
In view of the above, the present appeal is absolutely misconceived and this Court deprecates such filing of Miscellaneous Appeal by the counsels. The learned Counsels are expected to be more careful in filing cases. In the circumstances, the appeal is dismissed. (Dinesh Kumar Singh, J) ( Arvind Srivastava, J) mcv/- U
