JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-04-2022 For the reason of this case not having been taken up even once for a year, priority hearing has been given. Heard Mr. Rajeev Kumar, learned Advocate for the petitioner and Ms. Nirmala Kumari, learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Chiksoura P.S. Case No. 38 of 2020 dated 15.06.2020 instituted for the offences under Sections 341, 323, 504, 307, 379 and 506/34 of the Indian Penal Code. The petitioner has not been named in the FIR and his name has only surfaced during the course of investigation but without any specific overt act.

The learned counsel for the petitioner has submitted that similarly situated accused person has been granted anticipatory bail by a Bench of this Court. It has further been

No.28727 of 2021(2) dt.15-04-2022 2/2 submitted that because of petty dispute, the case has been lodged and for no apparent good reason, the name of the petitioner also has transpired during the course of investigation. There is a counter version of the occurrence also lodged by one of the co-accused persons viz. Jawahar Bind vide Chiksoura P.S. Case No. 39 of 2020.

Considering the afore-noted facts and taking into account that the petitioner does not have criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Hilsa, Nalanda in connection with Chiksoura P.S. Case No. 38 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
